“Nicke was scaring everyone, pretending to be crazy, asking people if they were famous,” said the source People magazine.

“He also faces a special allegation that he used a dangerous and deadly weapon, which is a knife,” Los Angeles County District Attorney Nathan Hochman said at a press conference. “These crimes carry a maximum sentence of life in prison without parole, or the death penalty.”
No decision has been made on whether prosecutors will seek it the death penalty.

However, if the death penalty were to be followed, Nick would not be sentenced due to a moratorium established by the Governor of California. Gavin Newsom in 2019.
Although the executive did not end the death penalty in California, it permanently halted all executions, an Oakland criminal defense attorney. Jo-Anna Nieves he told Fox News Digital.

“The executive order issued by Gavin Newsom stopped the executions, closed the San Quentin execution facility, stopped the lethal injection procedures, but it did not overturn the death penalty or overturn the death penalty imposed by the courts,” Nieves said. “California still has the death penalty on the books, and prosecutors are legally allowed to seek it in appropriate cases.”

“In fact, even if prosecutors could pursue the death penalty for Nick Reiner and get a conviction and a death sentence, no execution would happen under the current sentence,” he added. “The sentence will be legally in place, but its effect will remain suspended unless the suspension is lifted by a future governor or the law is changed by legislation or by voter action.”
The moratorium, however, could be lifted once a new governor is elected in 2026.
