Department of Homeland Security (DHS) Assistant Secretary Tricia McLaughlin on Saturday targeted Kilmar Abrego Garcia for “making TikToks” while DHS remains under arrest for an “activist judge.”

McLaughlin was reacting to a minute-long video that appears to show Abrego Garcia — an illegal immigrant from El Salvador who has become a centerpiece of the Trump administration’s deportation campaign — filming himself lip-syncing to a Spanish song.

“So, we [DHS]are under the orders of an activist judge and Kilmar Abrego Garcia makes TikToks,” McLaughlin wrote. “American justice ceases to function when its judges introduce law enforcement and give megaphones to those who oppose our legal system.”

KILMAR ABREGO GARCIA RELEASED AFTER JUDGE RULE TRUMP ADMIN WITHOUT AUTHORIZED REVOCATION ORDER

A court order was previously issued by an Obama-appointed judge barring DHS and other Trump administration officials from publicly discussing Abrego Garcia’s human trafficking case. That order was later reduced, according to The Tennessee Star.

Abrego Garcia has repeatedly sought to avoid public criticism by Trump administration officials, saying the comments threaten his right to a fair trial, Politico reported.

ABREGO GARCIA WAS RELEASED FROM PRISON, WILL RETURN TO MARYLAND TO AWAIT TRIAL

Abrego Garcia’s case has drawn national attention since March, when he was deported to his home country of El Salvador, in violation of a 2019 court order and in what Trump officials admit was “an administrative error.”

Upon his return to the US, Abrego Garcia was immediately arrested and charged with human trafficking that stemmed from the 2022 stop. The Trump administration says he is a member of MS-13, which Abrego Garcia denies.

A federal judge this week dismissed Abrego Garcia’s trial and scheduled a hearing to review whether prosecutors are pursuing human trafficking charges, according to the Associated Press.

Demonstrators gather to protest against the deportation of immigrants from El Salvador outside the Permanent Mission of El Salvador to the United Nations on April 24, 2025 in New York City. Most of the deportees now detained in El Salvador's Terrorism Confinement Center (CECOT) were sent there without trial under the Alien Enemies Act after an agreement was made by US President Donald Trump and El Salvador's President Nayib Bukele. A Maryland judge recently ordered the return of a 20-year-old Venezuelan man who was deported, citing a previous ruling involving Maryland man Kilmar Abrego Garcia who was mistakenly deported to his native El Salvador. US District Judge Paula Xinis on Monday also added a temporary restraining order preventing the Trump administration from re-arresting Abrego Garcia after he failed to issue a final removal order.

The ruling upholds a previous order that confirmed his release from ICE custody.
