Cannabis sales to Virginians could begin on November 1, 2026 – and small businesses could get first crack before the Big Marijuana Multistate operators.
That’s under the Proposed Proposed Plan they plan to present to GOV. – Hanging Abigail Spanberger, who promised to finally launch a legal sale after years of disruption.
Virginia became the first state in the South to legalize recreational marijuana in 2021, and state lawmakers doubled down on a bill that would have introduced regulated sales.

- Allowance for cannabis businesses to deduct certain costs in their state back to the Federal 280e limits.
- There is NO ability for cities and counties to opt out of legal retail sales.
Sales will be subject to a state tax of 8%, with localities able to impose an additional property tax of up to 3.5%.
When do you start selling adult marijuana?
With 8.6 million, Virginia could be one of the largest cannabis markets to open at some point.
The state reported nearly $30 million in sales in July and August, the first two months of state-mandated monitoring and tracking.
Cannabis sales for adult use could reach $780 million in the first full year of sales and exceed $1.09 billion in the second year, according to the MJBIZ publication.
According to a 2020 study commissioned by state lawmakers, Virginia can support between:
- 100 and 800 plant permits
- 30 and 150 processing or distribution licenses
- 200 600 licenses
